Bankruptcy:
With or without a bankruptcy attorney, bankruptcy allows consumers and businesses the opportunity to eliminate or repay the debt that they have incurred. Bankruptcy is a federal law and as such is heard in a federal bankruptcy court. There are two main types of consumer bankruptcies: Chapter 7 bankruptcies fall into the category of liquidation, while a Chapter 13 bankruptcy is a reorganization of debts.

Chapter 7 bankruptcy is considered liquidation because the bankruptcy trustee may take and liquate all of your assets that are not exempt. After the trustee sells the assets they will repay your unsecured creditors. A person who is filing for Chapter 7 bankruptcy will be able to keep some property called “exempt” property. The ability to exempt property from your bankruptcy can vary by state law.

Chapter 13 bankruptcy is a reorganization of debts. In this type of bankruptcy Debtors will typically be able to keep all of their property. However, they will be required to make a monthly payment to the trustee for three to five years. The trustee will then make payments to your creditors.

Foreclosure Defense:
Many homeowners today are not just walking away from their homes or property. They are hiring attorneys to defend their property against the lenders. A foreclosure is a lawsuit that is filed against a property owner in an attempt to take possession of the property and in some cases pursue a deficiency judgment against the homeowner.
If you are served with a foreclosure lawsuit, it is important to note that you have only 20 days to respond in the state of Florida. If you do not file an answer to the complaint (lawsuit) you may lose the opportunity to defend your home.
